1. Introduction

LaborNOW ("LaborNOW," "we," "us," or "our") operates the website located at labor-now.com (the "Site"). This Privacy Policy explains what information we collect through the Site, how we use and share it, and the choices available to you. It applies to visitors, prospective clients, and individuals who submit information through our contact form or apply for work through our linked application form. It does not govern the separate employment or engagement terms of individuals placed on client job sites, which are addressed in separate onboarding documentation.

2. Information We Collect

We collect information in the following ways:

• Information you provide directly. When you submit our contact form, we collect your name, company name, email address, phone number, project location, project interest, and any message or details you choose to include.
• Job application information. If you apply for work with LaborNOW, you are directed to a third-party application form (currently hosted by TempWorks HR Center). Information submitted there — which may include your name, contact details, work history, and eligibility-related information — is governed by that submission process and used for recruiting and onboarding purposes. We do not control the data-handling practices of that third-party form provider beyond the information it transmits to us.
• Automatically collected information. If you accept analytics cookies through our cookie banner, we collect standard web analytics data such as pages visited, general geographic region, device and browser type, and referring pages, via Google Analytics 4 with Consent Mode v2.
• Information from cookies and similar technologies. See Section 5 below.

3. How We Use Information

We use the information we collect to:

• Respond to inquiries submitted through our contact form and route them to the appropriate team;
• Evaluate and process job applications submitted through our linked application form;
• Understand how visitors use our Site so we can improve its content and structure;
• Maintain the security and proper functioning of the Site, including detecting and preventing spam or abusive form submissions; and
• Comply with applicable legal obligations.

We do not use information submitted through the Site for automated decision-making that produces legal or similarly significant effects without human involvement.

4. How We Share Information

We do not sell or rent personal information. We may share information in the following limited circumstances:

• Service providers. We use third-party service providers to operate the Site and process form submissions, including email delivery services (for contact-form notifications) and our job-application form provider. These providers are only permitted to use the information to perform services on our behalf.
• Legal requirements. We may disclose information if required to do so by law, subpoena, or other legal process, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
• Business transfers. If LaborNOW is involved in a merger, acquisition, or sale of assets, information collected through the Site may be transferred as part of that transaction, subject to the terms of this Policy.

5. Cookies and Tracking Technologies

The Site uses basic analytics cookies (Google Analytics 4, via Google's Consent Mode v2) by default to help us understand how visitors use the Site. A cookie notice on your first visit lets you opt out of analytics cookies at any time; if you opt out, analytics cookies are not set, and only essential functionality (such as remembering your preference) is used. You can change your preference at any time by clearing your browser's local storage for this Site and revisiting it, which will re-trigger the cookie notice.

6. Data Retention

We retain contact-form submissions for as long as reasonably necessary to respond to your inquiry and maintain business records, and no longer than legally required retention periods where applicable. Job application information is retained by our application form provider and by LaborNOW according to standard recruiting and employment recordkeeping practices, which may be longer than general inquiry data due to employment-law recordkeeping obligations.

7. Your Privacy Rights

Depending on your state of residence, you may have rights to request access to, correction of, or deletion of personal information we hold about you, and in some jurisdictions, a right to opt out of certain data uses. To exercise any of these rights, contact us using the information in Section 11. We will respond to verified requests within the timeframe required by applicable law. We do not discriminate against individuals for exercising privacy rights.

8. Job Applicants and Screening Information

For individuals placed on client work sites, LaborNOW or our clients may conduct background screening and drug screening as described on our Workforce & Safety page, where required by the project or applicable law. Any such screening is conducted under separate consent and disclosure processes specific to employment eligibility, consistent with the Fair Credit Reporting Act and applicable state law, and is not governed solely by this website Privacy Policy.

9. Children's Privacy

The Site is intended for business use by adults and is not directed to individuals under 18. We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected information from a child, we will take steps to delete it.

10. Data Security

We use reasonable administrative and technical safeguards designed to protect information submitted through the Site. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

11. Third-Party Links

The Site may link to third-party websites, including our job application form and social media pages. This Policy does not apply to those third-party sites, and we encourage you to review their own privacy policies.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Site after changes are posted constitutes acceptance of the revised Policy.
